An Element Occurrence (EO) is an area of land and/or water in which a species or natural community is, or was, present. An EO should have practical conservation value for the Element as evidenced by potential continued (or historical) presence and/or regular recurrence at a given location. For species Elements, the EO often corresponds with the local population, but when appropriate may be a portion of a population or a group of nearby populations (e.g. metapopulation). For community Elements, the EO may represent a stand or patch of a natural community, or a cluster of stands or patches of a natural community. Because they are defined on the basis of biological information, EOs may cross jurisdictional boundaries. An Element Occurrence record is a data management tool that has both spatial and tabular components including a mappable feature and its supporting database. EOs are typically represented by bounded, mapped areas of land and/or water or, as small scales, the centroid point of this area. EO records are most commonly created for current or historically known occurrences of natural communities or native species of conservation interest. They may also be created, in some cases, for extirpated occurrneces. Purpose: The Element Occurrence (EO) data are collected and maintained by the Montana Natural Heritage Program using a standardized methodology to provide accurate and current biodiversity and conservation information to public and private agencies and individuals. The primary emphasis is on species and ecological communities that are rare or otherwise imperiled. Use_Constraints: Use of the Element Occurrence Dataset by the licensed data users shall be governed by the following provisions: A. the Montana Natural Heritage Program grants to the data user during the term of this agreement a limited, nonexclusive, nontransferable, right of access to the Licensed Dataset provided therein solely for internal use; provided that those with access to the data and information shall in all respects treat them as the proprietary information of the Montana Natural Heritage Program and contributing Conservation Data Centres and Natural Heritage Programs in accordance with all procedures reasonably necessary to protect their proprietary rights in the data and information. The data users shall include the terms, conditions and procedures for protecting proprietary information on any products derived from these data. B. The data users may use the Licensed Dataset for internal purposes such as map generation, report generation, risk assessments, or data analyses. C. The products that may be generated for external distribution, based on the Licensed Dataset, include summary reports, journal publications, PhD dissertations or maps. These products shall not display or contain specific locational data for any named species, but shall at most indicate that there is a sensitive species at a specific location. The only allowable exception to displaying specific locational data for a named species would occur when data included in the Licensed Dataset is otherwise obtained from a source independent from the Montana Natural Heritage Program and the Conservation Data Centres / Natural Heritage Programs for the Licensed Dataset. D. the Montana Natural Heritage Program grants the licensed data users the right to share information with partner organization or cooperating federal agency employees on a limited basis as needed for land use, research and conservation planning purposes. This includes sharing information about species locations on a site-specific basis either verbally or as part of a written communication. This permission does not allow distribution of the Licensed Dataset, in whole or in part, to these cooperating agencies. Requests for access to the Licensed Dataset from cooperating agencies should be directed to the Montana Natural Heritage Program. E. The Licensed Dataset provided by the Montana Natural Heritage Program is intended to inform broad scale planning, land use, research and management decisions. When making conservation management decisions that impact species at a local scale, it is strongly recommended that the data user consult with the contributing Conservation Data Centres / Natural Heritage Programs to ensure that the data user has access to all available species information and expertise. F. No interest whatsoever is conveyed to the data user in right, title and interest in the Licensed Dataset and all copyrights (and renewals thereof) secured therein. All publication, dissemination and other rights in the Licensed Dataset are reserved to the Montana Natural Heritage Program in all languages, formats and throughout the world for the sole and exclusive use or any other disposition by the Montana Natural Heritage Program or its assignees or grantees at any time and from time to time without any obligation or liability to any user. G. The licensed data user shall reserve the right to publish and disseminate summary reports, journal publications, PhD dissertations or maps based on the Licensed Data Set. These publications shall not display or contain specific locational data for any named species, but shall at most indicate that there is a sensitive species at a specific location. H. The licensed data user shall not redistribute the Licensed Dataset to other agencies, organizations, companies, or individuals without prior written consent of the Montana Natural Heritage Program. Requests received by the licensed data user from other groups, organizations, or individuals for electronic or paper copies of lists, or other reports, or portions of the data thereof, should be directed to the dataset contact person (see: Section 1.9 "Point of Contact"). License to use this dataset expires on {date} (or 12 months after receipt of the Licensed Dataset), whichever is later, and the licensed data user shall not generate new maps, risk assessments, data analyses or other products from the Licensed Dataset after that date. Upon expiration, the licensed data user must delete the Licensed Dataset from its computer system. Locations are assigned a mapping precision of one of 3 primary levels: seconds, minutes and general. The locations coordinates are calculated in latitude and longitude using a map overlay. For point EOs, coordinates represent the population centroid of the element occurrence. The database is dependent on the research and observations of many scientists and individuals. In most cases this information is not the result of comprehensive site-specific field surveys, and is not confirmed by Heritage staff. Many areas have never been thoroughly surveyed, and new plants and animals are still being discovered. Database information should never be regarded as final statements or substituted for on-site surveys required for environmental assessments. Logical_Consistency_Report: Plotted latitudes/longitudes are checked against standard digital themes such as counties, watershed, and USGS quadrangle or NTS mapsheet. Completeness_Report: General: All data are provided as is. The Montana Natural Heritage Program makes no warranty as to the currency, completeness, or accuracy of any specific data. Since the data in the Montana Natural Heritage Program databases are continually being updated, it is advisable to refresh data received at least once a year after its receipt. The data provided are for planning, assessment, and informational purposes. The data should not be considered a definitive statement on the presence, absence, or condition of biological elements at any given location. The lack of data for any geographic area cannot be construed to mean that no significant features are present. Element Occurrence information is derived from site visits; published or unpublished literature, museum specimens, and personal communications. Not all information is known or made available to the Natural Heritage Program. Some data supplied to the NHP cannot be provided externally due to data sensitivity and/or security concerns. Many areas have not be adequately explored and new locations of species are continuously being discovered. Heritage information provides the best warning that an area may be rich in rare elements, but cannot be used to assess the opposite. Therefore, biological experts for certain species or land areas should be contacted to reconfirm species location and status. Taxonomic Completeness: EO data are tracked for all imperiled (G1/T1 - G2/T2) species and all federally Threatened and Endangered Species found within Montana when data are available. Vascular and Non-vascular Plants, Vertebrates, Invertabrates, and Fish are tracked when applicable. In addition, the following "Other" elements are tracked: Bird Rookeries, Bat Hibernaculum, State Champion Trees, and Peatlands. Geographic Completeness: In general, data are state-wide. However, there are some areas of the state where data are sparse. There are several large parcels of tribal lands scattered across the state, and data are often not available from these areas. Also, some areas have high concentrations of private lands where access to land for data collection is restricted. Lineage: Process_Step: Process_Description: Generally, NatureServe methodology has been followed to generate EO's. Deviations are noted in the database. Sub-EO's: Currently (as of 1/05), several species have EO records containing sub-EO's. However, only Greater Sage-grouse and Black-tailed Prairie Dog are definately going to keep this status. Due to the number, distribution, and specified separation distance of occurences of these species, the EO's consist of large numbers sub-EO's spread across large areas of the state. Sub-EO's consist of leks for Sage-grouse and towns for Prairie Dogs. Thus, any data pertaining to specific observations (for instance success or status) of any lek or town is kept at the sub-EO level, rather than in the principal EO. All other species containing sub-EO's are under review to determine whether sub-EO's have been appropriately applied and whether they should keep this status. Most will likely be rolled into single EO's with multiple source features.
